Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the KibbleGrade mobile application and related services (the “Service”). The Service is operated by Cesar Jiovani Hernandez (CXF Labs) (“KibbleGrade,” “we,” “us,” or “our”). By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1 Agreement to These Terms

By creating an account or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. You must be able to form a binding contract in order to use the Service.

2 What KibbleGrade Is

KibbleGrade helps you scan dog and cat food labels, read ingredient and nutrition information, generate a quality grade, flag common allergens and controversial additives, compare products, and estimate feeding amounts. Grades and estimates are generated automatically from the information available to us and are provided for general educational and informational purposes only.

We may add, change, or remove features at any time, and we do not guarantee that any product, grade, or piece of information is complete, current, or error-free.

3 Not Veterinary Advice — Important Disclaimer

You are solely responsible for decisions you make about your pet's care. To the fullest extent permitted by law, you rely on the Service at your own risk.

4 Eligibility and Your Account

To use certain features you must create an account and provide accurate information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized use. You may delete your account at any time from within the app (Profile / Settings → Delete Account) or via our account deletion page.

5 Subscriptions, Billing, and Auto-Renewal

Some features of KibbleGrade may require a paid subscription. Subscriptions are sold and processed through Google Play, and your purchase is also subject to the Google Play Terms of Service.

Price and billing period

The current price is $6.99 per month / $39.99 per year (plus any applicable taxes), as shown at the point of purchase in Google Play. A subscription gives you access for the billing period you select (for example, monthly or annual). Any free trial or introductory offer, if available, will be described at the point of purchase; if you do not cancel before the trial ends, it converts to a paid subscription.

Automatic renewal

Subscriptions automatically renew. Unless you cancel at least 24 hours before the end of the current period, your subscription will renew for another period of the same length, and your Google Play payment method will be charged the then-current price for that period. Renewal is handled by Google Play.

How to cancel

You can cancel at any time through Google Play: open the Google Play Store → your profile icon → Payments & subscriptions → Subscriptions → KibbleGrade → Cancel subscription. Cancellation takes effect at the end of the current billing period; you keep access until then. We cannot cancel a Google Play subscription on your behalf.

Refunds

Payments and refunds for subscriptions purchased through Google Play are handled by Google in accordance with the Google Play refund policies. We do not process payments and generally cannot issue refunds directly. To request a refund, use Google Play's refund process. Except where required by law, payments are non-refundable and partial-period charges are not prorated.

6 Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms;
• Reverse engineer, decompile, scrape, or attempt to extract source code or underlying data except as permitted by law;
• Interfere with, disrupt, overload, or attempt to gain unauthorized access to the Service or its systems;
• Upload content that infringes others' rights, is unlawful, or contains malware;
• Resell, sublicense, or commercially exploit the Service without our written permission;
• Rely on the Service as a source of veterinary, medical, or professional advice.

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial use, subject to these Terms.

7 Intellectual Property

The Service, including its software, design, text, graphics, logos, and the KibbleGrade name and branding, is owned by us or our licensors and is protected by intellectual property laws. Except for the limited license above, no rights are granted to you. Content you submit (such as pet profiles and photos) remains yours; by submitting it, you grant us a limited license to host and process it solely to operate and improve the Service, as described in our Privacy Policy.

8 Third-Party Services

The Service relies on third-party providers (for example, Google Play for distribution and billing, and the processors listed in our Privacy Policy). Your use of those services may be governed by their own terms and policies, and we are not responsible for third-party services or content.

9 Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that grades, ingredient analyses, feeding estimates, or other outputs are accurate, reliable, complete, or suitable for your pet, or that the Service will be uninterrupted or error-free.

10 Limitation of Liability

To the fullest extent permitted by law, KibbleGrade and its operator will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or for any harm to your pet or property, arising out of or relating to your use of (or inability to use) the Service or your reliance on any grade, analysis, or estimate — even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our total aggregate liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the twelve (12) months before the claim, or (b) USD $50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

11 Indemnification

You agree to indemnify and hold harmless KibbleGrade and its operator from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the Service, your violation of these Terms, or your violation of any law or the rights of a third party.

12 Changes to the Service and These Terms

We may modify the Service or these Terms from time to time. When we make material changes to the Terms, we will update the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13 Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Provisions that by their nature should survive termination (including Sections 3, 7, 9, 10, and 11) will survive.

14 Governing Law

These Terms are governed by the laws of California, USA, without regard to its conflict-of-laws rules. You agree that the courts located in the state or federal courts located in Los Angeles County, California will have jurisdiction over any dispute, except where applicable law provides otherwise.
